Electronic Signature Consent
This Electronic Signature Consent (“Consent”) governs the use of electronic signatures, records, notices, disclosures, and communications between PerimeterEye (“Company,” “we,” “us,” or “our”) and the customer (“Customer,” “you,” or “your”).
1. Consent to Electronic Signatures
By signing, clicking “I Agree,” creating an account, submitting information, completing a purchase, or otherwise using the Company’s services, Customer expressly consents to:
The use of electronic signatures, electronic acknowledgments, and electronic records;
Conducting transactions electronically;
Receiving agreements, disclosures, invoices, notices, updates, and other communications electronically; and
The legal enforceability of electronically signed documents to the fullest extent permitted by applicable law.
Customer agrees that electronic signatures shall have the same legal force and effect as handwritten signatures.
2. Electronic Delivery of Documents
Customer agrees that the Company may electronically provide:
Contracts and agreements;
Invoices and billing statements;
Payment authorizations;
Installation scheduling communications;
Service updates;
Policy changes;
Legal notices and disclosures;
Security alerts and account notifications; and
Any other operational or transactional communications.
Electronic delivery may occur through:
Email;
SMS/text message;
Customer portal/dashboard;
Mobile application notifications;
Website postings; or
Other electronic means designated by the Company.
Customer is responsible for maintaining accurate and current contact information.
3. Electronic Notices
Customer agrees that electronic notices from the Company satisfy any legal requirement that communications be provided in writing.
Electronic notices are deemed delivered and effective:
Immediately upon transmission through the platform or mobile application;
When sent by email to the Customer’s last provided email address; or
When sent via SMS/text or push notification to the Customer’s provided device.
Failure to access, review, or read electronic communications does not invalidate delivery.
4. Hardware and Software Requirements
Customer acknowledges responsibility for maintaining:
Internet access;
A valid email address;
A device capable of receiving electronic communications; and
Software capable of viewing PDF or web-based documents.
The Company is not responsible for inability to receive electronic notices caused by outdated contact information, internet outages, spam filtering, disabled notifications, or incompatible devices/software.
5. Withdrawal of Consent
Customer may withdraw consent to electronic communications by providing written notice to the Company. Withdrawal of consent:
Does not invalidate prior electronic agreements or signatures;
May delay or limit access to certain products or services; and
May require termination of certain electronically managed services or accounts if electronic delivery is necessary for operation.
The Company may require reasonable time to process withdrawal requests.
6. Record Retention
Customer is responsible for downloading, printing, or retaining copies of electronic records for their own files. The Company may, but is not obligated to, retain copies of electronic communications indefinitely.
7. Authority and Binding Effect
Customer represents that they have the legal authority to enter into agreements electronically and that all electronic actions taken through their account, email, device, or authentication credentials are authorized and binding.
Customer is responsible for maintaining the confidentiality and security of account credentials and authorized devices.
8. Consent to Use Electronic Records
Customer acknowledges that:
They can access and review electronic documents;
They have the ability to print or save records;
They understand the legal significance of electronic signatures and communications; and
They voluntarily consent to transact business electronically with the Company.
9. Updates to Electronic Communication Methods
The Company reserves the right to modify the methods used for electronic communications and delivery at any time. Continued use of the services after such modifications constitutes acceptance of the updated electronic communication methods.
